Know Your Flight Rights

Air passengers whose flights are operating within the EU have passenger rights which are primarily laid down in EU Regulation (EC) No. 261/2004. This regulation establishes the common rules on compensation in the event of a delayed, cancelled or overbooked flight. In the Montreal Convention, the rules for international flight disruptions have been established. Below, you can read more about common flight problems and your passenger rights, should such an event happen.

Delayed Flight Compensation

If your flight is delayed for a long time, the airline is obliged to provide care in the form of meals, refreshments, and even hotel accommodation. You might also be entitled to compensation of up to 600 euros per person. To be eligible, you must arrive at the final destination at least three hours later than planned and there must be no question of extraordinary circumstances beyond the control of the airline company. The amount of your compensation is determined by the flight distance.

Flight Cancellation Compensation

When your flight is canceled, you are entitled to a re-booking of your flight. If the trip is no longer a valid option for you, you can opt for a full refund of the ticket and a return flight to the first point of departure instead of a re-booking. In any case, you may be entitled to a flight compensation. A condition is that the airline did not inform you of the cancellation 14 days, or more, prior to your flight.

Overbooked Flight Compensation

Airline companies do not like to fly with empty seats. They often sell more tickets than there are seats on the plane. This is called overbooking. They anticipate that there are people who won’t show up, taking the risk of denying boarding to passengers. Thousands of passengers are refused access to their plane each year, even though they have all their travel documents and have checked in on time at the airport. With involuntary boarding denial due to overbooking you are also entitled to flight compensation up to €600!

Missed Connection Compensation

Did you miss your connection due to a delay at your first flight? In that case, you might be entitled to compensation. It does not matter how many hours your first flight was delayed. The point is that you missed your connection and therefore arrived at your final destination at least three hours later. This also applies if the connecting flight was operated by a different airline, as long as your flights were part of the same booking.

Flight Compensation Regulations

The flight compensation regulation that determines whether passengers are entitled to monetary compensation in the event of a flight disturb EC 261/2004.

EC 261

Has your flight been delayed, cancelled or overbooked? You might be entitled to compensation up to €600 per person based on EU Regulation 261/2004.

The EC 261/2004 Regulation applies to:

  • All flight within the EU
  • All flights departing from the EU
  • All flights departing outside the EU to the EU on a European airline
